These Terms and Conditions of Sale (the “Terms”) govern purchases made through the RC Marocky website, available at rcmarocky.com, and the relationship between RC Marocky and any person placing an order through the website (the “Customer”).
By placing an order on the website, the Customer confirms that they have read and accepted these Terms before completing their purchase.
These Terms apply subject to any mandatory consumer protection laws that may apply to the Customer.
1. About RC Marocky
RC Marocky is a platform dedicated to the world of RC Crawlers, RC Trail, Scale RC and custom RC builds.
The website offers vehicles, spare parts, accessories, equipment and components intended for radio-controlled modeling, as well as content and product selections developed around this hobby.
Products available on the website may come from different supply sources and specialized partners, including international partners.
RC Marocky selects the products offered based on their relevance to the RC hobby, their technical characteristics, availability, compatibility with certain platforms and, where possible, experience gained through their use or evaluation in RC projects and builds.
2. Products Offered
Photographs, illustrations and descriptions published on the website are intended to provide an accurate presentation of the products.
Certain characteristics may nevertheless vary depending on product versions, production batches or availability. If a product becomes unavailable after an order has been placed, RC Marocky will inform the Customer as soon as reasonably possible and may, depending on the circumstances, offer an alternative solution or issue a refund for the affected amount.
3. Prices
Prices displayed on the website are stated in the currency indicated during the purchasing process.
Applicable shipping charges are displayed before the final confirmation of the order, depending on the destination country, order value, type of product and available shipping method.
RC Marocky reserves the right to modify its prices at any time. The price applicable to an order is the price displayed when the order is confirmed.
Any customs duties, import taxes, clearance charges or other fees imposed by the destination country are not necessarily included in the displayed price. Their treatment is described in the section relating to shipping and customs procedures.
4. Orders
The Customer selects the products they wish to purchase and adds them to the shopping cart.
Before final confirmation, the Customer may review the contents of the order, quantities, shipping address, applicable shipping charges and total amount payable.
The order becomes final once payment has been successfully confirmed or, where applicable, according to the payment method offered.
An order confirmation may be sent to the email address provided by the Customer.
The Customer is responsible for ensuring that all information provided when placing an order is accurate, including their name, email address, shipping address and telephone number.
5. Payment
Payment is made using the payment methods available on the website at the time of purchase.
RC Marocky will never ask Customers to provide passwords, confidential authentication codes, PINs or banking authentication information by email, telephone or private message.
An order may be suspended or cancelled if payment has not been confirmed, if an irregularity is detected, or if information required to process the order is missing.
6. Order Processing and Shipping
Shipping times displayed on the website are estimates and may vary depending on the product, its availability, the supply source, shipping method, carrier and destination country.
Certain products may require additional processing time before shipment.
Once a parcel has been handed over to the carrier, transportation times may also vary depending on postal or logistics networks, periods of high activity, public holidays, customs procedures, weather conditions or other circumstances beyond RC Marocky’s reasonable control.
Where tracking information is available, it may be provided to the Customer so that the shipment can be followed.
The delivery timeframe stated at the time of purchase constitutes the reference information applicable to the order, subject to circumstances beyond RC Marocky’s control and any mandatory legal provisions applicable to the Customer.
7. International Operations and Partner Selection
RC Marocky works with several specialized partners and sellers located in different countries in order to provide a broader selection of RC products and references that may not always be readily available locally.
This organization provides access to products from different international supply channels and allows RC Marocky to build a selection suited to the needs of the RC hobby.
Certain products available through RC Marocky may therefore also be offered by the relevant partners or sellers on other online marketplaces or e-commerce platforms, such as Amazon, eBay, AliExpress, or similar platforms.
Prices on these different platforms are determined independently by the respective sellers and partners and may therefore differ from the prices displayed on RC Marocky, either higher or lower.
Such differences in price, promotional offers, availability or commercial terms do not, by themselves, constitute grounds for cancellation, refund or complaint concerning an order that has been validly placed through RC Marocky.
RC Marocky provides, within this framework, a specialized selection and cataloging service, together with experience developed through the use of certain products in its own RC projects and builds. The selection also takes into account, where possible, practical experience regarding product characteristics, availability and the delivery times generally observed during sourcing and transportation.
The purpose of this organization is to bring together, within a specialized RC-focused platform, a coherent selection of products for the RC community rather than simply reproducing the full catalogs available across the internet.
8. Delivery Times
Delivery times may vary significantly from one product to another.
For information purposes, a delivery timeframe may include several stages:
order preparation and processing;
handover to the carrier;
international transportation;
possible transit stages;
processing by the local carrier;
possible customs procedures;
delivery to the address provided.
A delivery timeframe displayed on a product page or during checkout should therefore be understood as an estimate where expressly indicated as such.
Delays caused by carriers, authorities, customs services or other circumstances outside RC Marocky’s reasonable control may extend the initially estimated delivery time.
RC Marocky will nevertheless make reasonable efforts to monitor orders and assist the Customer when difficulties arise during shipment.
9. Customs, Taxes and Destination-Country Regulations
Orders shipped to a country other than the country from which the goods are dispatched may be subject to customs procedures, taxes, import duties, restrictions or specific regulations.
These rules vary from one country to another and may change independently of RC Marocky.
The Customer is responsible for informing themselves, before placing an order, about the rules applicable to importing the products into their country, particularly where the products concerned may be subject to specific restrictions.
Unless otherwise stated at checkout, any customs duties, import taxes, customs clearance fees or other charges imposed by authorities or operators in the destination country are the responsibility of the Customer.
RC Marocky cannot guarantee that a particular shipment will be exempt from customs inspection, taxation, detention or import restrictions in the destination country.
Where a parcel is held, inspected or subject to an administrative procedure by the authorities of the destination country, the corresponding process may extend the delivery timeframe.
If a parcel is seized or confiscated by the competent authorities of the destination country due to applicable import regulations, RC Marocky shall not be held responsible for a decision made by those authorities, subject to any mandatory rights applicable to the Customer.
The Customer remains responsible for ensuring that the importation of the ordered product is permitted in their country.
10. Shipping Restrictions
Certain products may be subject to shipping restrictions or may not be eligible for shipment to certain countries due to the nature of the product, carrier regulations, international regulations or restrictions imposed by the destination country.
In such cases, RC Marocky may refuse or cancel the affected order and refund the corresponding amount in accordance with the applicable rules.
The availability of a product on the website does not therefore necessarily mean that it can be shipped to every country.
11. Shipping Address and Undelivered Parcels
The Customer must provide a complete and accurate shipping address that allows the parcel to be delivered.
RC Marocky shall not be held responsible for delivery difficulties resulting from an incorrect, incomplete or insufficient address, an incorrect telephone number, repeated absence of the recipient, or failure to collect a parcel within the period specified by the carrier or local postal service.
If a parcel is returned to the sender because of an incorrect address, refusal of delivery, failure to collect the parcel or another circumstance attributable to the Customer, additional charges may be required to arrange a new shipment.
The Customer may be required to pay such charges before a new shipment is arranged, subject to applicable consumer protection laws.
12. Right of Withdrawal
In accordance with applicable laws governing distance contracts, a consumer Customer may, where legally entitled to do so, exercise a right of withdrawal within seven (7) days from receipt of the goods.
Where applicable law provides for a different or more favorable period, that period shall apply.
A Customer wishing to exercise their right of withdrawal must contact RC Marocky within the applicable period, clearly stating their intention to withdraw and identifying the relevant order.
The product must be returned according to the instructions provided by RC Marocky.
Unless otherwise required by law, products should be returned in a condition allowing them to be resold, together with their accessories, components, documentation and packaging where necessary for their identification and protection.
The Customer must take reasonable precautions to prevent damage to the product during return shipment.
The right of withdrawal does not apply to cases expressly excluded by applicable law, including, where applicable, goods made according to the Customer’s specifications or clearly personalized goods, as well as other categories legally excluded from the right of withdrawal.
Refunds will be processed in accordance with applicable legal requirements after receipt and inspection of the returned product, or according to any other procedure required by applicable law.
13. Returns, Damaged or Non-Conforming Products
If a product received is defective, damaged during transportation or does not correspond to the order, the Customer should contact RC Marocky as soon as reasonably possible and, where possible, provide photographs or videos showing the issue.
Such information may be required in order to determine the appropriate procedure with the carrier, relevant partner or applicable after-sales service.
Products must not be returned to an address found on the parcel or provided by a third party without prior instructions from RC Marocky.
Any mandatory statutory warranties applicable to the Customer remain fully applicable.
14. Products Intended for RC Modeling
Products offered through RC Marocky are primarily intended for radio-controlled modeling.
Certain components may require technical knowledge, assembly, adjustment or appropriate installation.
The Customer is responsible for checking the compatibility of a part or accessory with their own configuration whenever specific compatibility is required.
When a product requires technical installation, RC Marocky recommends following the instructions supplied with the product and taking all necessary precautions during installation and use.
15. Product Availability and Changes
Manufacturers, suppliers and partners may modify certain product characteristics, references, packaging or versions without prior notice.
Where a significant modification directly affects a product already ordered, RC Marocky may contact the Customer in order to seek an appropriate solution.
Minor differences in packaging, presentation or accessories that do not affect the essential characteristics of the product do not necessarily constitute non-conformity.
16. Liability
RC Marocky takes reasonable measures to maintain the proper operation of the website, provide accurate information and monitor orders.
However, RC Marocky cannot be held responsible for events reasonably beyond its control, including:
interruptions or failures of communication networks;
carrier failures;
postal or logistics delays;
customs inspections or procedures;
natural disasters;
events affecting transportation networks;
decisions by administrative authorities;
import restrictions imposed by the destination country;
events qualifying as force majeure under applicable law.
Nothing in these Terms shall have the effect of excluding or limiting any mandatory statutory right or warranty to which the Customer is legally entitled.
17. Personal Data Protection
Personal data collected through the use of the website and the placement of orders is processed in accordance with the RC Marocky Privacy Policy.
Information necessary to fulfill an order may be used to process payment, prepare and ship the order, communicate with the Customer and provide after-sales assistance.
RC Marocky does not sell or rent its Customers’ personal data.

In the event of a dispute or difficulty, RC Marocky encourages the Customer to contact its customer service first in order to seek an amicable solution.
Nothing in these Terms shall have the effect of removing or restricting any statutory rights to which a consumer is entitled under mandatory applicable law.
